A) VISITOR

ACCESS TO ONLINE SERVICES OF THE PORTAL MIRWEBSITE.EU CONTRACT

Art. 1 – RECITALS

  • The registration on the website eu with the procedure referred to therein and in particularly with the final “I agree” and/or in any event, the access and use of the services provided by the portal mirwebsite.eu requires the prior approval of the General Conditions set out below. Therefore, the user/visitor is to be deemed to have read, understood and accepted the conditions and the access to online services contract will be completed. In case the compulsory personal data provided from the User/Visitor were wrong, incomplete, fictitious or non-existent, even after a subsequent control, MIR S.r.l. will preserve the right not to activate, to suspend or to terminate the Service in any moment without giving any prior notice.

1.2. M.I.R. S.r.l. and the new registered User accept all the General Conditions, they both acknowledge and agree that the selected User identification and the related Password are the only appropriate means to identify the User/Visitor entering the Services and for the entire duration of the Contract.

1.3. The User/Visitor is responsible for maintaining the confidentiality of the password for the entire duration of the Contract and is solely responsible for any damage caused by any such unauthorised access and use of the password and/or the User Identification.

 

Art. 2 – SUBJECT-MATTER

2.1 The terms and the conditions here below described concern the services provided by the Musical Instruments Register S.R.L. (shortly known as the acronym M.I.R. S.R.L.), company incorporated under the laws of Italy with a registered office in (26100) Cremona (Italy), Viale Po n. 52, VAT number, Tax Code and the Company Registration: 01709200198, REA: CR – 195449.

Art. 3 – Description, nature and contents of the provided services

3.1. M.I.R. S.r.l. puts at its online Users/Visitors’ disposal a database concerning the art of making instruments and, more generally, the musical instruments. Information provided by luthiers, makers of musical instruments and private and public collectors has been organized, catalogued and incorporated into a specific database, divided into the different consultation sections.

3.2. M.I.R. S.r.l. provides no assurance about the completeness, accuracy and reliability of the technical, esthetical and descriptive contents of the database information. M.I.R. S.r.l. has only an obligation of means by making available the information collected and undertakes only to verify the identity of the subjects providing the information.

3.3. M.I.R. S.r.l. reserves the right to refuse to allow certain information to be available and at its sole discretion to delete information on the site without giving any prior notice and any explanation. It will not consider any economic claims coming from the Users and/or any other third party.

Art. 4 – Protection of intellectual and industrial property rights (Copyright and related rights).

4.1 The ownership of the copyright and of any other intellectual and industrial property rights, excluding licensed software, concerning the design, the graphic, the images, the content, all the programmes to process the information and the source codes and the database on the site mirwebsite.eu are owned by M.I.R. S.r.l..

4.2. The services provided by M.I.R. S.r.l. include contents owned by M.I.R. S.r.l. and/or licensed by third parties expressly identified and they are all protected by copyright, the law on trade marks, on patents and other specific laws. M.I.R. S.r.l is the owner of all the rights and/or the only licensee for the contents and the services on the site mirwebsite.eu.

It is categorically prohibited to modify, copy, publish, distribute, licence, sell and/or directly or indirectly exploit in any way the contents of the site mirwebsite.eu.

4.3. Through the services provided by M.I.R. S.r.l., the User/Visitor is allowed only to see, take a copy and download the database contents on the website only for personal use and only in order to obtain specific information. Therefore, the User/Visitor is strictly prohibited to use the contents taken from the site mirwebsite.eu for commercial, business, promotional, professional and/or educational purposes, even if free of charge and/or non-profit-making.

4.4. Any total or partial reproduction and/or utilization, copying or distribution of mirwebsite.eu site contents for any use in discrepancy with the information contained in the present General Conditions, either free of charge or for commercial, professional or business purposes, is forbidden without the express authorisation of M.I.R. S.r.l.

4.5 Trade names, drawings, photos, brands or any distinctive symbols used on the website are owned exclusively by M.I.R. S.r.l. and shall not be used without the prior written consent of M.I.R. S.r.l..
Any hyperlinks to this site carried out using its own brand and/or distinctive symbols are also prohibited without the prior written consent of M.I.R. S.r.l..

 

Art. 5 – Processing of personal data (Privacy)

5.1. Consent

Using and consulting the site mirwebsite.eu, the User/Visitor expressively approves this Privacy Policy and is giving the consent for the processing of the data for the purposes described below.

5.2. Processing of personal data

This Privacy Policy is provided to ensure satisfactory compliance with its law obligations concerning personal data protection, that is the General Data Protection Regulation (EU) 2016/679 (hereinafter referred to as GDPR) and with the measures of the Personal Data Protection Supervisor Authority. Furthermore, the controller M.I.R. S.r.l believes that the privacy of its users is a fundamental element to be safeguarded in the context of its business and would, therefore, wish to provide any information to the interested party in order to ensure appropriate security of the personal data and to monitor the actual use of personal data.
5.2.1. Controller of data processing

The Data controller is Musical Instruments Register S.r.l. (shortly known as the acronym M.I.R. S.R.L.), company incorporated under the laws of Italy with a registered office in (26100) Cremona (Italy), Viale Po n. 52, VAT number, Tax Code and the Company Registration: 01709200198, REA: CR – 195449  in the person of its legal representative pro tempore domiciled at the registered office of the company.

  • 2.2. Place of data processing

Data processing connected with the web services of the site mirwebsite.eu takes place at the registered office of Musical Instruments Register S.r.l., in (26100) Cremona (Italia), Viale Po n. 52.
No data/information collected through consultation of the Site mirwebsite.eu will be communicated and/or shared to third parties. Personal data provided by Users/Visitors who request dispatch of informative material are used only for the purpose indicated at point 5.

  • 2.3. Purposes and methods of data processing

Personal data provided by the User/Visitor are used towards fulfilling their requests and requirements. Data is used towards dealing with the registration, consultation, purchase and use of the services provided by M.I.R. S.r.l.

While browsing our website, it is possible to have access to online services, entering personal data provided via electronic forms. Personal data may be used only for the purpose of fulfilling the service requested.

The computer systems and software procedures used to operate this website acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This category of data includes:

  • the IP addresses;
  • the URI (Uniform Resource Identifier) addresses of the requested resources;
  • the operating system used by the User/Visitor;
  • and other parameters relating to the user’s IT environment.

These data are used only to obtain anonymous statistical information on the use of the site and to check its correct functioning. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the site.

The sender’s email address or other personal data will be subsequently acquired by M.I.R. S.r.l. and processed in order to reply to requests or to provide the requested service. Personal data provided by the User/Visitor will be transferred to third parties only in case it is necessary to comply with the User’s requests.

While browsing our website, technical cookies can be installed on the User/Visitor’s device and the purpose to their use is to optimize the navigation and operation of the site.

  • 2.6. Rights of the interested parties

Pursuant to the European legislation 679/2016 (GDPR) and to the Art. 7 of Legislative Decree 30 June 2003, within the limits and in accordance with the procedures laid down by the legislation, the User has the right:
- to object, in whole or in part, for legitimate reasons, to the processing of personal data concerning the User provided for the purposes of commercial information or for sending advertising materials or direct selling or for carrying out market research or commercial communication;
- to request access to the personal data;

- to know the origin of the personal data;

- to have such data communicated in an intelligible form;

- to have information about the logic applied, the purposes and methods of data processing;

- to request correction, rectification, update, integration, erasure or transformation of your data in anonymous form or to obtain blocking of data processed in violation of the law, including those whose retention is unnecessary for the purposes for which the data were collected or subsequently processed;

- to obtain in a structured, commonly used and automatically readable form at the sole cost of the eventual record personal data concerning you provided to a data controller, in case of consent-based processing;

- right to lodge a complaint with the Supervisory Authority (Privacy Guarantor) for any alleged violation of the Regulation;

- more generally, to enforce the rights recognised by legal regulations in force.

In case of processing personal data on the basis of legitimate interests, the rights of the data subjects should be ensured (except the right to data portability which regulations do not foresee), in particular the right to object to the processing that can be exercised by sending a request to the Data controller. Requests shall be addressed to the Data controller, as above indicated.

Art. 6 – Contract duration and termination

The contract shall enter into force when M.I.R. S.R.L. allows the access to the services provided on the site mirwebsite.eu, following the procedures described hereto.

Art. 7– Limitation of liability

7.1. M.I.R. S.r.l. shall not be liable for any delay or failure in performance of the contract terms whether caused in whole or in part by unforeseeable events or force majeure.

7.2. M.I.R. S.r.l. shall not be responsible towards the User/Visitor, except where fraud or gross negligence,  for any delay or failure in connection with or related to the use of the Internet caused by events beyond its control or its providers’ control.
7.3. M.I.R. S.r.l. shall not be responsible for any damage, loss or costs incurred by the User/Visitor as a result of the non-performance of the contract for reasons not attributable to M.I.R. S.r.l., as then the User/Visitor shall be entitled to receive a full refund of the payment made and of any extra charges.

 

Art. 8 – Right of withdrawal

 

8.1. The User/Visitor has the right to cancel the contract within a period of 14 (fourteen) days starting from the day the User has been allowed to receive access to the online services provided on the site mirwebsite.eu, following the procedures described hereto.

8.2.  Notification of withdrawal shall be delivered to M.I.R. S.r.l. within the period of time above specified in order for the withdrawal period to start. To avail of the right of withdrawal it is required to provide an explicit declaration.

8.3. Upon receipt of the withdrawal communication sent by the User, the Parties will be released from their mutual obligations.

Art. 9 – Notifications and claims

9.1. Written notifications addressed to M.I.R. S.r.l. and any claims shall only be considered valid if they are sent to the following address: M.I.R. S.r.l., Viale Po n. 52, 26100 Cremona (Italy) or submitted by email to the address This email address is being protected from spambots. You need JavaScript enabled to view it.

9.2. The User/Visitor is required to indicate on the registration form the domicile or residence, the phone number and an email address to receive any notifications from  M.I.R. S.r.l.

 

Art. 10 – Transferability

This Contract may not be transferred by the User/Visitor without prior written consent of M.I.R. S.r.l. Any transfer or assignment made without prior written consent shall be null, void and of no effect.

Art. 11 – Applicable law and original version.

The contract is governed by the Italian law and the text in Italian shall constitute the sole authentic text, even if it has been translated also in other languages to facilitate the consultation for the User/Visitor.

Art. 12 – Competent Court

Both Parties agree and acknowledge that all disputes arising out of or in connection with this Contract, shall be finally settled under the rules of the Cremona Court (Italy).

 

B) INSTRUMENT MAKER - CERTIFICATION BODY - COLLECTOR

SERVICE CONTRACT FOR EXHIBITORS ON THE PORTAL MIRWEBSITE.EU

Art. 1 - Subject-matter

1.1. This Contract applies to trade relations between M.I.R. S.r.l. and the Exhibitors (art. 2.2) for data entering and processing on the database published on the website mirwebsite.eu (art. 2.1).

 

Art. 2 - Terms

2.1. M.I.R. is the database on the website mirwebsite.eu  related to manufacture of instruments and, more generally, the market of musical instruments. It is managed by Musical Instruments Register S.r.l., shortly known as the acronym M.I.R. S.R.L., company incorporated under the laws of Italy with a registered office in (26100) Cremona (Italy), Viale Po n. 52, VAT number, Tax Code and the Company Registration: 01709200198, REA: CR – 195449.

2.2.The Exhibitor is authorized to insert instruments into the MIR database in order to publish them on the portal mirwebsite.eu by requiring the registration. Subjects belonging to the following categories are entitled to become exhibitors:

  • 2.1 Bowed and plucked string instrument luthier

Experienced professionals with proven experience who have:

- Documentation required by the country in which they have their workshop/studio (for example, VAT number and Chamber of Commerce in Italy, VAT number or the equivalent for other European/extra European countries);

- Membership to professional associations or registers in countries where documentation stated above is not required.

  • 2.2 Guitar/ bass guitar luthiers

Experienced professionals with proven experience, as set out in the previous point (bowed string/string instrument luthiers).

  • 2.3. Other instrument makers (wind instruments, keyboard instruments, etc.)

Experienced professionals with proven experience who have:

  • Documentation required by the country in which they have their workshop/studio (for example VAT number and Chamber of Commerce in Italy, VAT number or the equivalent for other European/extra European countries);
  • Membership to professional associations or registers in countries where documentation stated above is not required.
  • 2.4. Certifying bodies

Internationally renowned experienced professionals with adequate professional training and technical knowledge.

  • 2.5. Conservatories, Foundations, Collectors

The owner (either public or private) is required to be in possession of the authenticity certificate or a letter or documentation for every instrument of any collection stating for certain the origin and the authenticity of the instrument in question.

In the absence of such documentation:

  • MIR experts will be working in order to provide an evaluation/cataloguing of the instruments;
  • MIR preserves the right to accept the registration.

If required, the ownership of the instruments can remain anonymous and MIR undertakes to preserve the strictest confidentiality.

 

 

 

Art. – 3. Description, nature and contents of the provided services

3.1. M.I.R. S.r.l. puts at Exhibitors' disposal a space into a database concerning the art of making instruments and, more generally, the musical instruments. Personal and professional data, picture of instruments, their origin, technical and aesthetic features and any other information useful to identify the instruments exhibited shall be provided by the Exhibitor and will be accessible to the Visitor.

3.2. MIR S.r.l.'s role does not go beyond the processing of information provided by Exhibitors that has been organized, catalogued and incorporated into a specific database, divided into the different consultation sections.

3.3. M.I.R. S.r.l. provides no assurance about the completeness, accuracy and reliability of the technical, esthetical and descriptive contents of the database information. M.I.R. S.r.l. has only an obligation of means by making available the information collected and undertakes only to verify the identity of the subjects providing the information.

Therefore, the Exhibitor is solely responsible for the correctness, authenticity and veracity of the information provided, which must be attributed only to the Exhibitor.

3.4 M.I.R. S.r.l. reserves the right to refuse to allow certain information to be available and at its sole discretion to delete information on the site without giving any prior notice and any explanation. It will not consider any economic claims coming from the Exhibitors and/or any other third party.

 

Art. – 4 How to register Exhibitors

4.1 The registration of Exhibitors on the mirwebsite.eu site takes place through the procedure indicated below.

The access and use of the services provided by the portal mirwebsite.eu requires the prior approval of the General Conditions set out below. Therefore, the User/Visitor is to be deemed to have read, understood and accepted the conditions.  In case the compulsory personal data provided from the Exhibitor were wrong, incomplete, fictitious or non-existent, even after a subsequent control, MIR S.r.l. will preserve the right not to activate, to suspend or to terminate the Service in any moment without giving any prior notice, without prejudice to the possibility of seeking a judicial review to protect their own rights and interests.
4.2  M.I.R. S.r.l. and the new registered Exhibitor accept all the General Conditions, they both acknowledge and agree that the selected Exhibitor identification and the related Password are the only appropriate means to identify the Exhibitor accessing the online services.

4.3 The Exhibitor is responsible for maintaining the confidentiality of the password for the entire duration of the Contract and is solely responsible for any damage caused by any such unauthorised access and use of the password and/or the User Identification.

4.4. The registration of a “New User” on the portal can be carried out both as a natural and legal person.

4.5. The Exhibitor concerned to carry out the registration is requested to click on the button “REGISTER”, to choose in the dialog box the right category and to fill in the registration form. Subsequently, the Exhibitor is required to confirm:

- the approval of the privacy regulations;

- to have read in full the “Terms and conditions”, the “Registration requirements” and “How to register”..

In the registration form

Natural persons are required to insert:

  • - an identification document (identity card, passport, driving licence);
  • - a profile picture;
  • - a short CV for the profile.

 

Legal persons are required to insert:

  • - Company and/or firm’s logo;
  • - Chamber of commerce company registration and/or an equivalent document.
  • - a short CV for the profile.

 

4.6. After having received the filled in forms and the required information, M.I.R. S.r.l. will send to the Exhibitor an email with the authorization to access the portal within one working day in order to have the possibility to register the instruments on the portal.  

4.7. The Exhibitor will be allowed a reasonable period to register the instruments built during the previous years. Once the time is expired, the annual limitation will come into play according to the category and instruments have to be registered as detailed below.

Art. 5 – How to insert data into the category of “Bowed/ plucked string instrument luthiers”.

5.1. It is requested to insert for each instrument 3 high-definition photos (front/back/head-headstock) in order to recognize it unequivocally and to appreciate the construction qualities. In case of low-resolution photos MIR guarantees neither the correct printing of the certificate nor an appropriate view on the portal.

5.2. Concerning the instruments inserted by the maker luthier, it is requested that the instruments comply with the deontological principles of handcrafted manufacturing. For the registration of new instruments, the luthier is obliged to respect the following annual limit: 12 violins and violas - 10 cellos - 8 double basses - 15 guitars - 80 bows. In case of construction in the same year of instruments belonging to two or more categories, this limit shall not exceed the amount of 10 instruments.

Art. 6 –  How to insert data into the category of “Guitar/ bass guitar luthiers”.

6.1. It is requested to insert for each instrument 3 high-definition photos with the same features as specified above in the section of bowed/ plucked string instruments  in order to recognize it unequivocally and to appreciate the construction qualities. The maximum limit is 15 for each year of construction.

Art. 7 – How to insert data into the category of “Other instrument makers” ( wind instruments and keyboard).

7.1. It is requested to insert for each instrument 3 high-definition photos  in order to recognize it unequivocally and to appreciate the construction qualities. The maximum limit is 20 instruments for each year of construction.

Art. 8 –  How to insert data into the category “Certifying bodies”.

8.1. Certifying bodies with proven experience, as mentioned below, shall have the possibility to insert “Authenticity certificate” drawn up by themselves.

Art. 9 – How to insert data into the category “Musicians, Conservatories, Foundations, Collectors”.

9.1. It is requested to insert for each instrument 3 high-definition photos  in order to recognize it unequivocally and to appreciate the construction qualities, an authenticity certificate and documentation proving times and methods of acquisition. The maximum limit is 20 instruments for each year of construction.

Art. 10 – Protection of intellectual and industrial property rights (Copyright and related rights).

10.1 Exhibitors are required to release MIR S.r.l. from any liability related to copyrights and any other intellectual and industrial property rights concerning the design, graphic, images, texts. source and contents of the information provided. Therefore, Exhibitors shall be themselves the holders of the mentioned above rights and/or shall be free to dispose of their rights.

10.2. By signing this contract, Exhibitors are required to licence  M.I.R. S.R.L the economical use of copyrights and any intellectual or industrial property rights concerning the design, graphich, images, texts, sources and contents of the information provided, in so far as it relates solely to the possibility of keeping them in the database over and beyond the duration of this contract. Therefore, Exhibitors shall declare to be aware that third parties will be allowed to refer to information provided by themselves also beyond the duration of the contract, upon payment of a fee exclusively to M.I.R. S.R.L., and Exhibitors shall renounce any economic request and claim in this regard.

10.3 M.I.R. S.r.l. ensures that Visitors authorized to access information on the portal mirwebsite.eu, are allowed only to see, take a copy and download the database contents on the website only for personal use and only in order to obtain specific information. Therefore, the User/Visitor is strictly prohibited to use the contents taken from the site mirwebsite.eu for commercial, business, promotional, professional and/or educational purposes, even if free of charge and/or non-profit-making. Any total or partial reproduction and/or utilization, copying or distribution of mirwebsite.eu site contents, either free of charge or for commercial, professional or business purposes, is forbidden.

Art. 12–  Contract duration and termination

The contract shall enter into force when M.I.R. S.R.L. allows the Exhibitor the access to the services provided on the site mirwebsite.eu, following the procedures described hereto.

Art. 13 – Limitation of liability.

13.1. M.I.R. S.r.l. shall not be liable for any delay or failure in performance of the contract terms whether caused in whole or in part by unforeseeable events or force majeure.

13.2. M.I.R. S.r.l. shall not be responsible towards the Exhibitor, except where fraud or gross negligence, for any delay or failure in connection with or related to the use of the Internet caused by events beyond its control or its providers’ control.

13.3 M.I.R. S.r.l. shall not be responsible for any damage, loss or costs incurred by the Exhibitor as a result of the non-performance of the contract for reasons not attributable to M.I.R. S.r.l., as then the Exhibitor shall be entitled to receive a full refund of the payment made and of any extra charges.

Art. 14 - Right of withdrawal.

14.1. The Exhibitor has the right to cancel the contract within a period of 14 (fourteen) days starting from the day the Exhibitor has been allowed to receive access to the online services provided on the site mirwebsite.eu, following the procedures described hereto.

14.2.  Notification of withdrawal shall be delivered to M.I.R. S.r.l. within the period of time above specified in order for the withdrawal period to start. To avail of the right of withdrawal, it is required to provide an explicit declaration.

14.3. Upon receipt of the withdrawal communication sent by the Exhibitor, the Parties will be released from their mutual obligations.

Art. 15 – Notifications and claims

15.1. Written notifications addressed to M.I.R. S.r.l. and any claims shall only be considered valid if they are sent to the following address: M.I.R. S.r.l., Viale Po n. 52, 26100 Cremona (Italy) or submitted by email to the address This email address is being protected from spambots. You need JavaScript enabled to view it.

15.2. The Exhibitor is required to indicate on the registration form the domicile or residence, the phone number and an email address to receive any notification from  M.I.R. S.r.l.

 

Art. 16 – Transferability.

This Contract may not be transferred by the Exhibitor without prior written consent of M.I.R. S.r.l. Any transfer or assignment made without prior written consent shall be null, void and of no effect.

Art. 17 – Applicable law and original version.

The contract is governed by the Italian law and the text in Italian shall constitute the sole authentic text., even if it has been translated also in other languages to facilitate the consultation for the Exhibitors.

 

Art. 18 – Competent Court

Both Parties agree and acknowledge that all disputes arising out of or in connection with this Contract, shall be finally settled under the rules of the Cremona Court (Italy).

C) ANCILLARY SERVICES

FURTHER SERVICES FOR EXHIBITORS ON THE PORTAL MIRWEBSITE.EU

M.I.R. S.R.L. put at Collector and, more generally, Exhibitors’ disposal the following further ancillary services:

  • support and generic advice for the evaluation, identification and cataloguing of the information, included graphic and photographic elements, which will be published on the site eu;
  • support for data and information entering directly provided by M.I.R. S.R.L.. Each registered instrument will be assigned a unique ID (not replicable);
  • QR-Code generator service for each registered instrument and possible supply of adhesive paper for printing;
  • Authenticity Certificate for each registered instrument with specific paper print support. If the resolution of the uploaded photos for the instrument registration is lower than our indication, MIR does not guarantee neither a proper printing of the certificate nor a proper view on the portal.
